1. Acceptance of Terms

By accessing and using the Tide Wellness website ("Site") and purchasing products from Tide Wellness ("Company," "we," "us," or "our"), you ("Customer," "you," or "your") accept and agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you must not use this Site or purchase our products.

These Terms constitute a legally binding agreement between you and Tide Wellness, a Canadian-based supplier of research peptides. We reserve the right to modify these Terms at any time, and such modifications will be effective immediately upon posting. Your continued use of the Site following any changes indicates your acceptance of the new Terms.

2. Research Use Only

All products sold by Tide Wellness are intended strictly for research purposes only. Our peptides are not intended for human consumption, therapeutic use, or any medical application. Products are sold as research chemicals for in vitro research and laboratory analysis only.

By purchasing from Tide Wellness, you represent and warrant that you are a qualified researcher, laboratory professional, or institution conducting legitimate scientific research. You agree not to use our products for any purpose other than research and laboratory analysis.

Tide Wellness makes no claims regarding the safety, efficacy, or suitability of our products for human use. Any information provided on this Site regarding biological effects, mechanisms of action, or potential applications is for educational and research purposes only and does not constitute medical advice or endorsement for human consumption.

3. Product Information and Accuracy

We strive to provide accurate product descriptions, specifications, and pricing information. However, we do not warrant that product descriptions, images, pricing, or other content on the Site is accurate, complete, reliable, current, or error-free.

All products are sold with Certificates of Analysis (COA) demonstrating purity and composition as determined by third-party HPLC testing. While we maintain rigorous quality control standards, we reserve the right to correct any errors, inaccuracies, or omissions and to change or update information at any time without prior notice.

4. Ordering and Payment

Orders are subject to acceptance and availability. We reserve the right to refuse or cancel any order for any reason, including but not limited to product availability, errors in pricing or product information, or suspicion of fraudulent activity.

Payment must be received in full before products are shipped. We accept payment methods as indicated on the Site. All prices are listed in Canadian Dollars (CAD) unless otherwise specified and are subject to change without notice.

By providing payment information, you represent and warrant that you are authorized to use the designated payment method and authorize us to charge the total amount of your order to that payment method.

5. Shipping and Delivery

We ship products within Canada only. Shipping times are estimates and not guaranteed. Tide Wellness is not responsible for delays caused by shipping carriers, customs, weather, or other circumstances beyond our control.

Risk of loss and title for products pass to you upon delivery to the shipping carrier. You are responsible for providing accurate shipping information. We are not liable for products delivered to incorrect addresses provided by the customer.

Products requiring temperature-controlled storage are shipped with appropriate cold chain packaging. Upon receipt, you are responsible for immediately transferring products to appropriate storage conditions as specified in product documentation.

6. Returns and Refunds

Due to the nature of research peptides and regulatory requirements, all sales are final. We do not accept returns or provide refunds except in cases of demonstrable product defect or shipping error on our part.

If you believe you have received a defective product or incorrect item, you must contact us within 48 hours of delivery with photographic evidence and your order number. We will investigate and, at our sole discretion, may offer a replacement or refund.

Products that have been opened, used, improperly stored, or damaged due to customer handling are not eligible for return or refund under any circumstances.

7. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, TIDE WELLNESS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES.

Our total liability to you for any claim arising out of or relating to these Terms or your use of our products shall not exceed the amount you paid for the specific product giving rise to the claim.

We are not liable for any harm, injury, or adverse effects resulting from the misuse, improper handling, or unauthorized use of our products. You assume all risks associated with the purchase, storage, handling, and use of research peptides.

8. Indemnification

You agree to indemnify, defend, and hold harmless Tide Wellness, its officers, directors, employees, agents, and affiliates from and against any and all claims, damages, obligations, losses, liabilities, costs, and expenses (including attorney's fees) arising from: (a) your use of our products; (b) your violation of these Terms; (c) your violation of any third-party rights; or (d) any misrepresentation made by you.

9. Intellectual Property

All content on this Site, including text, graphics, logos, images, and software, is the property of Tide Wellness or its content suppliers and is protected by Canadian and international copyright laws. You may not reproduce, distribute, modify, or create derivative works from any content without our express written permission.

The Tide Wellness name, logo, and all related product names, designs, and slogans are trademarks of Tide Wellness. You may not use these marks without our prior written permission.

10. Regulatory Compliance

You are solely responsible for ensuring that your purchase, possession, and use of our products complies with all applicable federal, provincial, and local laws and regulations in your jurisdiction.

Our products are not approved by Health Canada or any other regulatory authority for human or animal use. You acknowledge that the regulatory status of research peptides may vary by jurisdiction and that you are responsible for understanding and complying with all applicable regulations.

11. Age Restriction

You must be at least 18 years of age to purchase products from Tide Wellness. By placing an order, you represent and warrant that you are at least 18 years old and have the legal capacity to enter into this agreement.

12. Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of the Province of Ontario and the federal laws of Canada applicable therein, without regard to conflict of law principles.

Any dispute arising out of or relating to these Terms or your use of our products shall be resolved through binding arbitration in accordance with the Arbitration Act of Ontario, rather than in court. The arbitration shall be conducted in English in Ontario, Canada.

13. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary so that these Terms shall otherwise remain in full force and effect and enforceable.

14. Entire Agreement

These Terms, together with our Privacy Policy and any other legal notices published on this Site, constitute the entire agreement between you and Tide Wellness concerning your use of the Site and purchase of products.
